Extended Producer Responsibility (EPR) laws addressing single-use packaging are rapidly expanding across the United States, significantly impacting producers.

As of 2025, seven states—California, Colorado, Maine, Oregon, New Jersey, Minnesota, and Washington—have enacted legislation requiring manufacturers and brand owners to assume responsibility for the collection, recycling, or disposal of their packaging waste.

These laws typically mandate participation in Producer Responsibility Organizations (PROs), shifting the financial and operational burden from municipalities to producers. Companies failing to comply risk severe penalties, including substantial fines, such as California’s SB 54, which imposes daily penalties up to $50,000 for violations.

Non-compliant producers also face increased operational costs, restricted market access, and reputational harm. To avoid these repercussions, companies must proactively invest in sustainable packaging alternatives, improve recyclability, and actively participate in diversion programs to ensure compliance with the evolving regulatory landscape.
